Lincoln City Oregon (the “House” or “Castlewood”),
and is entered into between the owners Castlewood (“Owner”)
and (“Guest”), who is set forth below.

**This deposit should be submitted in a separate check, with “Security Deposit”
marked on the memo line. This check will be cashed, and we will write you a new
 check in full refund provided there is no damage or missing items following your stay.
 We will have a Check For Items checklist and Priority Checklist for your security
measures.  P

 Please do not tamper the Smoke Detectors, rearrange any furniture and unplug the power cords
of DVD/VCR, TV, Phone, Computer, and Wireless router
. Your security deposit will be charged
if there is any damage to the flooring, furniture, or anything else in the House as well if Cleaning
Crew has to spend extra time to set up the items mentioned above.

A 50% deposit is required with this contract to confirm and hold your
reservation. The remaining 50% is due 30 days prior to check-in.

If your deposit is not received by the return date above, we reserve the
right to cancel your reservation and open the dates for others to reserve.

Severability.  If any provision of this agreement is held to be invalid
or unenforceable, such provision shall be stricken from this agreement
and the remaining provisions of this agreement shall be enforced and
enforceable as written.

Attorney Fees. The party prevailing in any action related to the occupancy
of the House by Guest, visitors of Guest, members of Guest’s party or any
occupants of the House, or to enforce this agreement, or vindicate rights
under this agreement shall be awarded its reasonable attorney fees and
costs in said action.

Applicable Law and Forum.  Any disputes arising under this agreement
or relating to the occupancy of the House by Guest, visitors of Guest,
members of Guest’s party or any occupants of the House shall be decided
under the laws of the State of Oregon with the forum for said dispute being
in the circuit court of Washington County, Oregon.

Guest, along with all members of Guest’s party staying at Castlewood, agree
to comply with the Policies as set forth in this agreement.  Owner also reserves
the right to terminate occupancy without refund should violations of the
policies set forth in this agreement or occupancy limits occur.

Guest certifies that he is 27 years of age or older, and will be staying with
the group. Guest agrees to the terms of this agreement, and ensures that
Guest and members of Guest’s party will conduct themselves responsibly
and lawfully during their stay.

Waiver and Release of Liability

1.  Owners of Castlewood are not liable for loss, damage of property,
    injury to me or my guests during my stay on the premises. 

2.  I hereby release, waive, discharge, and covenant not to sue the owners
    of Castlewood, its officers, servants, agents, or employees for any liability,
     claim, and/or cause of action  arising out of or related to any loss, damage,
     or injury, including death, that may be sustained by me, or to any property
     belonging to me arising out of use of the house or property.

3.  I understand that the Oregon beach can be dangerous.  It is subject to
    unexpected “sneaker” waves, shifting driftwood, tidal surges, rip tides
     and stormy weather. I assume all risks associated with the beach and will
    not hold the owners of Castlewood, its officers, servants, agents, or employees
     liable for any injury or death that occurs on the beach.

4.  This release shall be effective whether the injury is caused by my negligence,
    the negligence of the owners of Castlewood, its officers, servants, agents,
    or employees, or the negligence of any third party.                                           

I have read and agree to the terms of this agreement; I have read and agree to
the terms of the Waiver and Release of Liability.
